General Terms and Conditions of Use

1. Scope of Agreement
These Terms of Service govern your use of the ZANOA platform, intended for film, television, and media industry professionals. The platform provides:
- Content feed for industry updates
- Personal and company profiles
- Project pages for productions
- Colleague verification and networking
- Job board and listings
- Messaging and collaboration tools
Users must be 13+ years old. All platform features are accessible only to logged-in members. The company may modify or expand services over time with notification.
2. Services & Membership Categories
Basic Membership (Free)
- • Limited job posting capabilities

Premium Membership (€9.99/mo)
- • Unlimited messaging
- • Post unlimited jobs
- • Advanced search filters
- • Full project management tools
Membership is available to both individuals and companies. Monthly auto-renewal via Apple App Store or Google Play. The company reserves the right to introduce new tiers or modify pricing.
3. Registration & Accounts
Registration requires truthful information including:
- Name and email address
- Secure password
- Professional role or company details
The company may request verification of identity or credentials. Users are limited to one account per individual unless otherwise authorized. You cannot impersonate others or misrepresent your affiliation. Accounts are personal to the registered entity and not transferable. Inactive accounts may eventually be removed.
4. Account Security & Use
You are responsible for maintaining password confidentiality and are liable for any unauthorized account use.
You must not:
- Share login credentials with others
- Use your account for fraud, deception, or to circumvent security measures
- Engage in disruptive use or system testing
- Select usernames that impersonate others
The company may reclaim or reassign usernames if needed.
5. Profiles & User Content
Users can create profiles with photos, videos, demo reels, and biographies. Content must be accurate and up-to-date. You are responsible for the truthfulness of all profile information.
Content Ownership & License:
- You retain ownership of your original content
- You grant the company a license to use, display, distribute, and create derivatives
- You must have rights to all content posted (photos, videos, music)
- Content is visible only to logged-in users (closed community)
The company may remove or moderate content that violates these terms. Content may persist on the platform for backup and legal compliance even after deletion. Users should back up important content themselves.
6. Projects & Collaboration Tools
Users can create Project Pages for productions (reference or active collaboration). The project creator becomes the administrator and is responsible for accurate information.
Key Requirements:
- • All project data must be truthful; you cannot create projects without a legitimate connection
- • Colleague verification: Users linked to the same project become "colleagues"
- • Role misrepresentation (e.g., claiming lead role when you were an extra) is a serious violation
- • Projects generally cannot be deleted arbitrarily if others are linked to them
Collaboration spaces include task assignment, file sharing, chat, calendars, and call sheets. Private project content is treated as confidential. Project admin powers must be used responsibly. Completed projects remain as archived references.
7. Content Standards & User Obligations
Prohibited Content:
- • Unlawful, defamatory, fraudulent, racist, violent, or sexually explicit material
- • Harassment, bullying, threats, or content promoting discrimination
- • Minors in sexual situations (absolutely forbidden)
- • Extremist symbols (especially strict in Germany)
- • Copyrighted material without permission or intellectual property violations
- • Spamming, trolling, or unsolicited contact
Users are expected to conduct themselves professionally and courteously. Copyright owners can request takedowns, and repeat infringers' accounts may be terminated. You are responsible for legal compliance including data protection, export controls, and labor laws.
8. Content Moderation & Account Suspension
The company is not obligated to pre-screen all content but reserves the right to monitor. We may:
- Remove content or edit for compliance
- Disable features, issue warnings
- Suspend or terminate accounts
- Take action without prior notice in certain cases
Appeals process is available; decisions are final. Premium members are not refunded if content is removed or account suspended due to violations. Terminated users are prohibited from creating new accounts. The company is not liable for consequences of moderation actions taken in good faith.
9. Job Board & Listings
Premium members and companies can post job listings. All listings must:
- Be relevant to film/media/entertainment industry
- Include: job title, detailed description, location, compensation
- Include application process and closing date
- Be genuine opportunities (no scams or MLM schemes)
- Not violate labor laws or discriminate unlawfully
- Be transparent about internships or volunteer work terms
Listings are active for approximately 30 days unless marked as filled earlier. The company is not an employer—we simply provide the venue. Users should exercise due diligence. No guarantee of finding candidates or being hired.
10. Personal Data & Privacy
Data processing is governed by our Privacy Policy and complies with GDPR:
Your Rights
Access, correct, delete, restrict, export data, and object to processing under GDPR Articles 15-21.
Security
Profiles visible only to logged-in users. Search engines cannot index the platform. Reasonable security measures in place.
Private messages are processed by the company (not end-to-end encrypted). We do not sell personal data to third parties. Based in Germany, directly under GDPR jurisdiction.
11. Intellectual Property
The company owns all platform IP including software, design, trademarks, and content. Protected by copyright and trademark law.
Limited License:
- • Non-exclusive license for personal/business use
- • Cannot copy, modify, reverse-engineer, or create derivatives
- • License terminates if violated; legal remedies available
You retain ownership of your posted content but grant the company a license to display and distribute it. All rights not expressly granted are reserved.
12. Premium Subscription Contract & Commencement
Upgrade offers are made through app store interfaces. The contract is formed when payment is processed and premium features are enabled.
- EU consumers have a 14-day "cooling-off" period but waive it by starting the service immediately
- Premium billed monthly (€9.99) via Apple/Google; auto-renews until cancelled
- Failure to charge results in account downgrade to Basic (but not charged again)
- Billing occurs on the anniversary date of subscription
- Trials may be available with terms explained at sign-up
13. Payment, Billing & Fees
€9.99/month
(including VAT)
- Processed through app stores (Apple/Google handle payment securely)
- Company doesn't store credit card details directly
- Auto-renewal continues until cancelled
- User responsible for updating payment info with app store; failed payments may result in cancellation
- Fees are non-refundable once charged (digital service consumed as provided)
- Exceptions: billing errors or serious service failure
Cancellation: Settings → Subscriptions → ZANOA → Cancel (must be 24 hours before renewal). Simply deleting the app doesn't cancel your subscription.
14. Price Changes
The company may modify Premium pricing in the future with:
- 30+ days advance notice required before increases
- Notice via email and/or in-app notification
- Users can cancel before new price takes effect
- Continuing use after notice period = acceptance of new price
Temporary promotions don't count as increases when reverting to normal pricing. The goal is transparency—users always have the option to cancel.
15. Term & Termination
The contract starts at registration/activation and continues until terminated.
User Termination
- • Basic: Terminate anytime via account deletion (no fee)
- • Premium: Cancel via app store; access continues until period end
- • Can rejoin by registering again (but old data is gone)
Company Termination
- • For convenience: 14 days notice (free members)
- • For paid: 30+ days notice if discontinuing service
- • For cause: Immediate termination, no refund
Deleted accounts are not recoverable. Terminated users may not re-register without permission. Certain provisions survive termination (IP, liability limitations, governing law).
16. Limitation of Liability
- Company fully liable for deliberate intent or gross negligence
- For slight negligence on essential duties: liable only for foreseeable damages
- Unlimited liability for death/personal injury or fraud
- Not liable for user-generated content or disputes between users
- Users responsible for their own data backups
- Not liable for third-party service failures or force majeure events
- No liability for incidental, indirect, or consequential damages (lost profits, lost data, business interruption)
17. Indemnification (Freistellung)
You agree to indemnify the company for third-party claims arising from:
- User-posted content (copyright infringement, defamation)
- User activities violating law or these terms
- Penalties or fines imposed on the company due to user actions
Indemnity survives account termination. Users with significant legal risk should carry liability insurance.
18. No Set-off & No Retention Rights
Users cannot offset claims against amounts owed to the company, except if claims are undisputed or legally adjudicated. You cannot withhold performance (e.g., refuse to pay) based on retention rights.
19. Transfer of Contract (Assignment)
The company may assign the contract to another entity (merger, acquisition, reorganization). Transfer doesn't reduce user rights. Users may have the right to object within one month under German law.
Users cannot assign their account or contract to others without written consent. Accounts are personal and non-transferable.
20. Amendments to Terms
The company may amend these terms for service changes, legal/regulatory adaptation, or clarification:
- Significant changes require 30+ days advance notice
- Notification via email and/or in-app message
- Users have the right to object to changes (typically 30-day window)
- No objection + continued use = acceptance of new terms
- If user objects to mandatory changes: contract terminates at effective date
Previous versions are maintained for reference.
21. Final Provisions
Governing Law: German law (without conflict of laws principles). EU consumers retain mandatory consumer protections.
Jurisdiction: Berlin, Germany (for business users and non-EU consumers). EU/EEA consumers can sue in their home jurisdiction.
Language: English is the official language; translations are for convenience only.
Severability: Invalid or unenforceable provisions are severed but remaining terms stay in force.
Entire Agreement: These terms + Privacy Policy = entire agreement, superseding prior understandings.
